Обязанности родителей по воспитанию детей
Во все времена, воспитание детей и забота о них, являлись основной обязанностью родителей. Но, к сожалению, сегодня, эти обязанности не редко нарушаются.
В первобытном обществе, воспитанием потомства занимались всем племенем, обществом, кланом, это была традиция, так как дети – это наше будущее. Во время становления матриархата усиливается связь с ребёнка с отцом, так как считалось, что женщина принадлежит ему, а, следовательно, и ребёнок, как её часть.
В разные этапы развития нашей истории отношение к детям координально менялось. Когда-то к ним относились так же, как мы сейчас относимся к животным, но уже двадцатый век стал «столетием ребёнка», общество осознало, что главными в воспитании ребёнка являются Родители. Именно их забота важна для его всестороннего развития, умения проявить себя. Иначе кто научит ребёнка тому, как надо существовать в социуме?
В современном обществе появилось множество проблем, связанных с защитой материнства, деградации семей, их социальной незащищенности и т.д. Эти проблемы вызваны отсутствием эффективной государственной политики, и не тщательно продуманных реформ. Пока не наблюдается определенной молодёжной и детской политики, с каждым годом увеличивается количество малолетних преступников, бездомных детей, безнадзорных, которые даже нигде не учатся. Единственной защитой детей я является «семейное законодательство», но оно, к сожалению, не заменит родителей и даже редко обязывает их к воспитанию, чаще происходит простое лишение прав на ребёнка. В Европейских странах была принята Конвенция ООН 1989 г. «О правах ребенка», это документ, «определяющий права детей на образование, пользование достижениями культуры, правом на отдых и досуг, и оказание иных услуг детям государствами-членами ООН».
Основные положения семейного кодекса РФ (СК РФ) от 29.12.1995 N 223-ФЗ
*Согласно семейному кодексу РФ (СК РФ) от 29.12.1995 N 223-ФЗ, родители несут равную ответственность за детей, а так же имеют равные права и обязанности. Ответственность снимается при достижении ребёнком 18 лет, а так же при вступлении несовершеннолетних детей в брак, т.е. при полной самостоятельности, дееспособности, и возможности обеспечивать себе достойную жизнь.
*Несовершеннолетние родители, так же имеют право на совместное проживание с ребёнком и его воспитание, но только при достижении им шестнадцати лет. Если родитель не достиг установленного возраста, ребёнку назначается опекун.
*Родители обязаны обеспечить развитие и образование своих детей, и имеют преимущественное право перед другими лицами. Они должны заботиться о физическом, психологическом здоровье ребёнка, а также должны обеспечить получение общего и среднего образования.
*Родители являются законными представителями своих детей, и должны обеспечивать защиту их прав и интересов ребёнка, даже в суде. Обеспечение интересов детей – главный предмет заботы родителей.
*Согласно пункту 1 ст. 65 родитель не должен препятствовать общению ребёнка с другим родителем.
Так же данный пункт содержит список действий родителей, которые они не в праве совершать: причинение физического, нравственного и психического вреда; жестокое, грубое, унижающее человеческое достоинство обращение с ребёнком; оскорбление (как словом, так и действием) и эксплуатация (выходящее за рамки семейного воспитание использование труда) ребёнка.
Нарушение сформулированных в данной статье положений влечёт за собой: лишение прав на ребёнка; отменой усыновления, опекунства.
